Limited Warranty & Disclaimer

This Limited Warranty & Disclaimer applies to your use of the Meteora IQ software application and related services (the “Software”) provided by USER-SEC, LLC. It works together with, and is subject to, the End User License Agreement and the Terms of Service.
1. Limited Performance Warranty
Meteora IQ warrants only that the Software will perform substantially in accordance with the Product Documentation (published in the Documentation section) under normal use during your paid subscription term. This limited warranty does not apply to problems caused by (a) your inputs, data, or files; (b) use of the Software in violation of the EULA or Terms of Service or outside its documented scope; (c) third-party services, hardware, networks, or software; or (d) causes outside our reasonable control.
2. Exclusive Remedy
If the Software fails to conform to the limited warranty above and you notify us at info@launchboxapps.io within thirty (30) days of the nonconformity, your sole and exclusive remedy, and our entire obligation, will be for us to use commercially reasonable efforts to correct the nonconformity, or, if we cannot, to refund the fees you paid for the affected period and terminate your access. No other remedy is available for breach of this limited warranty.
3. No Other Warranties
EXCEPT FOR THE LIMITED WARRANTY IN SECTION 1, THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, USER-SEC, LLC, LaunchBox Apps, AND THEIR RESPECTIVE AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS (THE “PROTECTED PARTIES”) DISCLAIM ALL OTHER WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SOFTWARE OR ITS OUTPUTS WILL BE ACCURATE, COMPLETE, RELIABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.
4. No Professional Advice; Outputs Must Be Verified
The Software is a calculation and visualization tool. It is not a licensed engineer, surveyor, or inspector, and its outputs — including deflection and tilt calculations, elevation transpositions, contour maps, 3D models, failure indicators, and recognized text — are machine-generated and may contain errors. A qualified, appropriately licensed professional must independently verify every output before it is relied upon or included in any report, certification, or stamped work product. The Protected Parties make no warranty of any kind with respect to outputs, and have no liability for outputs affected by your inputs or by your failure to review and verify them.
5. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE PROTECTED PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS. THE PROTECTED PARTIES’ TOTAL LIABILITY FOR ANY INDIVIDUAL CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY OR $100, AND THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED $5,000. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
6. Claims
To make a warranty claim, contact info@launchboxapps.io with:
- the email address on your account;
- a description of the nonconformity and how to reproduce it;
- the date you first observed it.
Claims made more than thirty (30) days after you first observed the nonconformity are waived to the fullest extent permitted by law.
